The following Terms and Conditions govern the use of Site Monitors and all content, services available at or through the website sitemonitors.net. The provided services are owned and operated by USA Domains Inc., and Site Monitors is a separate service of USA Domains, Inc. The services are offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation Site Monitors Privacy Policy) and procedures that may be published from time to time on this website by Site Monitors (collectively, the "Agreement").
By accessing or using any part of the services, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the products or use any services. If these terms and conditions are considered an offer by Site Monitors, acceptance is expressly limited to these terms. We may modify these terms or any additional terms that apply to Site Monitors services. Changes will apply immediately and may apply retroactively to all our existing users. If you do not comply with these terms, and we don't take action right away, this doesn't mean that we’re giving up any rights that we may have (such as taking action in the future). If any of these Terms and Conditions are rendered invalid or void, the other Terms and Conditions will remain in fact. The section titles in the Terms and Conditions are for convenience only and have no legal or contractual effect.
All users with an account are responsible for maintaining the security of your account (e-mail, password, or API keys) and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You must not using Site Monitors services in a misleading or unlawful manner, including in a manner intended to trade on the name or reputation of others, and Site Monitors may change or remove any content that it considers inappropriate or unlawful, or otherwise likely to cause Site Monitors liability. You must immediately notify Site Monitors of any unauthorized uses of your account or any other breaches of security. Site Monitors will not be liable for any acts or omissions by You, including any damages of any kind incurred as a result of such acts or omissions.
By using the products, you are entirely responsible for:
Site Monitors has the right to, in our sole discretion (i) refuse or remove any content (monitors, status pages) that, in Site Monitors's reasonable opinion, violates any Site Monitors policy or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the products to any individual or entity for any reason, in Site Monitors's sole discretion. Site Monitors will have no obligation to provide a refund of any payments previously paid.
Site Monitors automatically checks the monitors defined by you in user-defined intervals. And, once a downtime is detected, it can notify the "user-defined contacts" with various methods (like e-mail, SMS, Slack, Discord, Telegram, Flock, etc.).

By registering and creating an account at Site Monitors (sitemonitors.net) you are automatically subscribed to the FREE plan. Free plan includes 5 monitors and 1 status page with a unique Site Monitors URL only.
Paid plans include a specific number of monitors and status pages and by default use a unique Site Monitors URL unless the plan you select offers Status page customization.
The Site Monitors Free Plan is intended solely for personal, non-commercial use. This plan is designed for users who seek basic uptime monitoring services for personal use, personal websites, personal projects, or other non-commercial or non-profit applications. Use of the Free Plan for any commercial purpose, including but not limited to business, institutional, or revenue-generating activities, is strictly prohibited.
By selecting an Upgrade you agree to pay Site Monitors the monthly or annual subscription fees indicated for that service. Payments will be charged on a pre-paid basis on the day you sign up for an Upgrade and will cover the use of that service for a monthly or annual subscription period as indicated. When you change plans, there is no refund for unused time on the previous plan.
Site Monitors reserves the right to change the payment terms and fees.
Unless you login to Site Monitors before the end of the your subscription period and cancel your plan, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee for such plan (as well as any taxes) using any credit card we have on record for you. Plans can be canceled at any time in the Account section of your site's dashboard.
You may terminate your subscription to the Plan at any time and you will not be obligated to pay any additional fees for upcoming subscription renewal periods. However, any subscription fees you have paid in advance will not be refunded unless there has been 10 days or less since the payment. For payments made in the last 10 days or less, only those payments are refundable.
Site Monitors may terminate your access to all or any part of the products at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your Site Monitors account, you may simply discontinue using the products. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
The services are provided "as they are". Site Monitors and its suppliers and licensor's hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Site Monitors nor its suppliers and licensor's make any warranty that the products will be error-free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the products at your own discretion and risk.
This Agreement constitutes the entire agreement between Site Monitors and you concerning the subject matter hereof, and they may only be modified by the posting by Site Monitors of a revised version. Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the services will be governed by the laws of the United States in the State of North Carolina. You may assign your rights under this Agreement to any party that consents to, and agrees to be bound by, its terms and conditions; Site Monitors may assign its rights under this Agreement without condition. This Agreement will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.
